A State Supreme Court Judge has ruled that any disciplinary actions against members of the Syracuse University Fraternity Theta Tau can't be taken until a hearing takes place.
Back in April they were involved in a viral video littered in racism. Now that video has been seen around the country.
Supreme Court Judge James McClusky will be the one conducting the hearing. The chapter filed with the Supreme Court in an attempt to get back into school.
“Syracuse University is aware of a state court order issued yesterday. If left standing, it will allow certain Theta Tau members to return to campus this semester. The University is challenging yesterday’s order, which contradicts a federal court decision from earlier this summer," said Dara Royer, Senior Vice President and Chief Communications Officer.
